1. Introduction and Scope of Agreement
1.1 These Terms and Conditions apply to any contract for goods or services entered into between Hi-Tech Spray Coatings T/A SprayMasters UK and you, the client. Once you confirm your order, you agree to be bound by these terms.
1.2 This contract outlines your rights and responsibilities and our obligations in delivering the services as agreed upon in our proposal or quotation.
1.3 Any amendments or changes to these terms must be agreed upon in writing, and we reserve the right to make necessary changes to comply with legal or regulatory requirements, with one month’s notice.
2. Information We Provide to You
2.1 As required by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, we will provide you with clear and comprehensive information before you enter into a contract with us. This includes details about the services, pricing, timelines, and your rights to cancel.
2.2 The information we provide forms part of this contract, and you should read it carefully before proceeding with any order.
2.3 By accepting our terms and proceeding with your order, you acknowledge that you have received all necessary information required to make an informed decision.
3. Formation of Contract and Order Process
3.1 Once you place an order for our services, whether in person, by phone, email, or through our website, we will provide written confirmation of your order, at which point a legally binding contract is formed.
3.2 Before accepting any order, we will perform a thorough site assessment to ensure the viability of the project. This includes evaluating the condition of the surface to be sprayed, the structural suitability for the service, and any legal considerations.
3.3 Following this assessment, we will provide you with a detailed written quotation. By accepting this quotation, you acknowledge that the information provided during the assessment is accurate and sufficient for us to proceed with the agreed services.
3.4 Upon confirmation of your order and receipt of your 30% non-refundable deposit, we will begin the process of procuring the specialized materials required for your project. These materials include binders and coatings sourced from Europe, specifically manufactured for your project, and as such, cannot be returned or reused for other projects.
4. NO REFUNDS Policy After 14 Days
4.1 We operate a strict no refund policy after the expiration of the 14-day cooling-off period. After 14 days from the date of order acceptance, no refunds will be issued, including for the deposit, regardless of whether the service has commenced.
4.2 The 14-day cooling-off period begins the day after the contract is formed (i.e., the day after you receive confirmation of your order). During this period, you may cancel the contract for any reason, and we will issue a full refund of any payments made, including the deposit.
4.3 However, once this period has expired, any deposits or payments made are non-refundable, unless otherwise required by law.
4.4 The rationale behind this firm stance is based on the bespoke nature of the materials we use. Once an order is confirmed, we immediately initiate the procurement process for specialized binders and coatings. These materials are custom-made for each project and sourced from suppliers across Europe. As they are non-returnable and made to order, their cost is non-recoverable.
4.5 Cancellation requests after the 14-day period will not be entertained. Any cancellation within the cooling-off period must be submitted in writing via Royal Mail recorded delivery to our head office. A cancellation is only valid once we confirm receipt of your letter or email.
4.6 After 14 days, Hi-Tech Spray Coatings T/A SprayMasters UK will have already committed substantial financial and operational resources, including placing non-refundable orders for the specialized coatings and binders. This makes it impossible to offer refunds beyond the cooling-off period.
5. Deposits and Payment Schedule
5.1 A 30% non-refundable deposit is required upon placing an order. This deposit confirms your booking and enables us to commence the procurement of materials specific to your project.
5.2 The remaining 70% balance is payable upon completion of the project. Payment must be made in full on the day of completion unless alternative payment arrangements have been agreed upon in writing prior to the commencement of the project.
5.3 Any delays in payment will result in the application of interest charges on the outstanding balance. Interest will be charged at a rate of 5% per annum above the base rate of NatWest Bank plc until full payment is received.
6. Right to Cancel
6.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel this contract within 14 days without giving any reason.
6.2 If you request that services begin during the 14-day cooling-off period, you will be responsible for any costs incurred up to the point of cancellation, including but not limited to the procurement of materials and any preparatory work completed.
6.3 If services are fully completed within the 14-day period at your request, you lose the right to cancel and must pay for the services in full.
6.4 To cancel the contract, you must send written notification via Royal Mail recorded delivery to our head office or by email. Cancellation requests are only considered valid once we confirm receipt in writing.
6.5 If you cancel within the 14-day cooling-off period, we will refund all payments made, less any deductions for services provided up to the point of cancellation. Reimbursements will be made within 14 days of receiving your cancellation notice.
7. Materials Procurement and Custom Manufacturing
7.1 Our spray coating services rely on the use of specialized materials, including binders, pigments, and coatings, that are specifically ordered and manufactured for each project.
7.2 These materials are sourced from European suppliers and are custom-made to meet the specific needs of your project. Due to their bespoke nature, these materials are non-returnable and non-reusable for other projects.
7.3 Once an order is placed and materials are procured, we are financially committed to our suppliers, which is why no refunds can be provided after the cooling-off period.
8. Service Timeline and Delivery
8.1 We will provide you with an estimated timeline for the completion of the services. While we strive to meet all deadlines, certain factors may affect the timeline, including material availability, weather conditions (for exterior work), and other unforeseen circumstances.
8.2 If delays occur due to circumstances beyond our control, we will inform you as soon as possible and agree on a revised timeline for the completion of the work.
8.3 We reserve the right to charge for any delays caused by your failure to provide access to the worksite or delays caused by other contractors.
9. Variations to the Project
9.1 Any requests for changes to the scope of the project must be provided in writing and agreed upon by both parties before any additional work is carried out.
9.2 Changes to the project may result in additional costs, which will be communicated to you prior to the commencement of any varied work.
9.3 If additional work is required due to unforeseen circumstances or conditions that were not apparent during the initial assessment, we will inform you immediately and seek your approval for any changes in
scope or price.
10. External Spraying and Weather Conditions
10.1 External spray coating services are highly dependent on weather conditions. We reserve the right to reschedule work if we deem weather conditions unsuitable for spraying (e.g., rain, extreme humidity, or high winds).
10.2 If adverse weather conditions persist, we will communicate with you to arrange an alternative date for completion. We are not liable for any delays caused by weather conditions that are beyond our control.
10.3 If you insist that we proceed with external work despite adverse weather conditions, you will be required to sign a waiver, acknowledging that we cannot guarantee the finish or durability of the coating applied under these conditions.
11. Customer Responsibilities and Site Access
11.1 It is your responsibility to ensure that the site is prepared and accessible for our team. This includes providing clear and safe access to the work area, removing obstacles, and ensuring that other contractors or tradespeople are not interfering with the work we are carrying out.
11.2 If delays occur due to inadequate site preparation or access, we reserve the right to charge for the additional time and costs incurred.
11.3 Non-SprayMasters UK personnel, including children, pets, or other animals, must be kept clear of the work area at all times to avoid exposure to solvents, coatings, and other potentially hazardous materials.
12. Previously Painted Surfaces Disclaimer
12.1 While we have extensive experience in spraying over previously painted surfaces, we cannot guarantee the same results in every instance. Factors such as the type of previous paint, its condition, age, and how well the surface was prepared can affect the adhesion and longevity of our coatings.
12.2 For the highest-quality and most durable results, we recommend stripping the surface back to its original substrate before applying new coatings. This ensures proper adhesion and a long-lasting finish.
12.3 We will not be held responsible for issues arising from spraying over previously painted surfaces, particularly if the condition of the surface was not fully disclosed during the initial assessment.
13. uPVC Colour Fading Disclaimer
13.1 We provide a guarantee for uPVC spray coatings, but this guarantee is contingent upon proper maintenance. The use of incorrect cleaning agents or failure to follow our care guidelines will void the warranty.
13.2 Should uPVC windows or surfaces fade or deteriorate due to improper maintenance or use of inappropriate cleaning agents, we are not responsible for the repair or replacement of the coating.
13.3 Our team will provide detailed instructions on how to maintain the coating, and it is your responsibility to adhere to these guidelines to preserve the longevity of the finish.
14. Limitation of Liability
14.1 Except in cases of personal injury or death caused by our negligence, Hi-Tech Spray Coatings T/A SprayMasters UK is not liable for any losses or damages that were not foreseeable at the time the contract was formed.
14.2 We are not liable for any business-related losses, loss of revenue, or indirect damages. Our liability is limited to the value of the contract for services provided.
15. Disputes and Legal Jurisdiction
15.1 In the event of a dispute, we will make every effort to resolve the issue through negotiation and mediation. If the dispute cannot be resolved, you may seek Alternative Dispute Resolution (ADR), and we will comply with any ADR process.
15.2 This contract is governed by the laws of England and Wales, and any disputes arising from this agreement will be subject to the jurisdiction of the courts of England and Wales.
16. Termination of Contract
16.1 We reserve the right to terminate this contract if you fail to meet your obligations, including failure to make payments on time, failure to provide access to the worksite, or if you make unreasonable demands that alter the scope of the work.
16.2 If the contract is terminated due to your breach of these terms, you will remain liable for any costs incurred up to the point of termination, including the cost of materials and labour already provided.
These Terms and Conditions are designed to protect both you, the client, and us, Hi-Tech Spray Coatings T/A SprayMasters UK. By agreeing to these terms, you confirm that you understand and accept the obligations and responsibilities outlined.
If you have any further questions or require clarification on any of these terms, please contact us at sales@spraymastersuk.co.uk.
We reserve the right to charge for costs incurred relating to late notification of cancellation (48 hours or less) by the client.
Payment Terms:
Payment is strictly as per the terms on the quotation. On Completion of the project, strictly on the day of completion.
